Welcome to Evolving Tours. These Terms & Conditions govern the relationship between Evolving Tours and all participants booking services through our agency.
By confirming a reservation and completing payment, participants acknowledge that they have read, understood and agreed to these Terms & Conditions together with our Cancellation & Refund Policy, available on our website.
These conditions apply to all services offered by Evolving Tours.
1. Acceptance of Terms
By sending passenger information and confirming a reservation with Evolving Tours, participants acknowledge that they have read and accepted these Terms & Conditions as well as the Cancellation & Refund Policy available on our website.
Completion of payment confirms acceptance of these conditions and finalizes the reservation.
2. Booking and Payment
Reservations are considered confirmed once payment has been received and the services have been secured with the corresponding operators.
Payment may be made through various authorized methods including:
• online booking platforms
• secure payment links
• credit card payments
• bank transfers
• authorized booking systems
• cash payments when applicable
Once payment has been completed, the reservation becomes confirmed and subject to the applicable cancellation policy.
3. Confirmation of Services
Once a reservation has been confirmed, Evolving Tours proceeds to secure the requested services with the corresponding local operators, including vessels, guides, transportation providers and other service partners.
Confirmed reservations represent operational commitments with these providers.
4. Role of Evolving Tours
Evolving Tours acts as an intermediary between travelers and independent service providers.
These providers may include:
• boat operators
• naturalist guides
• transportation companies
• accommodation providers
• activity operators
While Evolving Tours carefully selects trusted partners, these services are operated by independent providers and subject to their operational conditions.
5. Client Responsibilities
Participants are responsible for:
• providing accurate passenger information
• reviewing booking details before confirmation
• arriving on time at meeting points
• following the instructions of guides and operators
• respecting local regulations and environmental guidelines
Failure to comply with these responsibilities may result in the loss of participation in activities without refund.
6. Operational Changes
Travel in the Galápagos Islands involves natural conditions and logistical limitations.
Evolving Tours reserves the right to modify itineraries, schedules, routes or activities when necessary due to:
• weather conditions
• sea conditions
• operational requirements
• safety considerations
• regulations of the Galápagos National Park
• decisions by captains or certified guides
Such adjustments are considered part of normal tour operations and do not constitute grounds for refund.
7. Safety and Activity Risks
Certain activities offered in the Galápagos Islands involve inherent risks, including but not limited to:
• snorkeling
• diving
• boat excursions
• hiking
• wildlife observation
Participants acknowledge these risks and voluntarily agree to participate in such activities.
Participants are responsible for evaluating their own physical condition and comfort level before joining activities.
8. Travel Documentation
Participants are responsible for ensuring that they carry all required travel documentation.
This may include:
• valid passports
• migration control cards
• Galápagos National Park entry permits
• other travel documents required by authorities
Failure to present required documentation may prevent participation in certain services.
9. Health and Travel Insurance
Participants are responsible for ensuring they are medically fit to participate in the activities booked.
Evolving Tours strongly recommends that travelers obtain comprehensive travel insurance covering:
• medical expenses
• trip interruptions
• emergency evacuation
• accidents during activities
Evolving Tours is not responsible for medical costs or personal incidents occurring during the trip.
10. Environmental Responsibility
The Galápagos Islands are a protected ecosystem.
Participants must follow the regulations established by the Galápagos National Park, including:
• not feeding wildlife
• not removing natural elements
• staying on designated trails
• respecting wildlife observation guidelines
Failure to comply with these regulations may result in penalties imposed by local authorities.
11. Limitation of Liability
Evolving Tours shall not be held responsible for circumstances beyond our control including but not limited to:
• weather conditions
• sea conditions
• flight delays or cancellations
• transportation disruptions
• lost or damaged luggage
• illness or personal accidents
Our responsibility is limited to the coordination of services booked through our agency.
12. Force Majeure
Evolving Tours shall not be liable for failure to perform services due to circumstances beyond our control including but not limited to:
• natural disasters
• extreme weather events
• government restrictions
• transportation interruptions
• strikes or operational disruptions
In such cases, Evolving Tours will make reasonable efforts to provide alternative arrangements whenever possible.
13. Communication and Booking Records
Communication regarding reservations may occur through various channels including email, messaging platforms or booking systems.
Written communication related to the reservation may be used as confirmation of services and agreement to the applicable policies.
14. Credit Card Payments and Chargebacks
Payments made by credit card are subject to the applicable booking and cancellation policies.
Participants agree that once a reservation has been confirmed and services have been secured with operators, the transaction represents a valid charge.
In the event of a credit card dispute or chargeback, Evolving Tours reserves the right to contest the dispute by providing supporting documentation including booking confirmations, payment records and communication history.
15. Governing Law
These Terms & Conditions shall be governed by the laws of the Republic of Ecuador.
Any dispute arising from services provided by Evolving Tours shall be subject to the jurisdiction of the competent courts of Ecuador.
